Welcome to Memorarto. These Terms and Conditions ("Terms") govern your use of our website and the commissioning of bespoke artworks.

Memorarto is a trading name of Craig Baxter Design Studio Ltd, a company registered in England & Wales (Company No. 13361130). All commissions are fulfilled and invoiced through this legal entity.

By using our services, you agree to be bound by these Terms.

1. Introduction

Memorarto is a bespoke art studio offering commissioned artworks created by Craig Baxter.

  • These Terms apply to all custom art commissions initiated via our website or through direct contact.

  • These Terms are governed by the laws of England and Wales.

  • These Terms do not affect your statutory rights.

2. Definitions
  • "We" / "Us" / "Our": Memorarto and Craig Baxter

  • "You" / "Client": The person commissioning artwork

  • "Commissioned Artwork": Bespoke, made-to-order art based on your supplied materials

3. Services

We currently offer:

  • Bespoke Commissions: Custom artworks created using your personal images and stories, available in multiple sizes

4. Ordering Process

  1. Enquiry Form: To begin, please complete our enquiry form and upload up to three sample photographs. This helps us understand your story and determine if we’re a good fit.

  2. Commission Confirmation: We’ll review your submission and respond within 48 hours. If we believe we can do your story justice, we’ll invite you to secure your place with a 50% deposit, which confirms your booking in our creative calendar.

  3. Story & Photo Submission: Once your deposit is received, we’ll ask you to complete a story form and provide a secure link for uploading the rest of your photos. Please note, you will need to upload your story and images by a stated date in order to keep within expected turnaround times. 

  4. Creative Process: Craig will design your artwork using your photos alongside additional visual elements that help tell your story. These may include hand-crafted textures, self-generated patterns, Creative Commons or stock imagery, and other illustrative assets. You’ll receive a digital version for feedback. One round of light revisions (e.g. layout, colour, or emphasis tweaks) is included. Significant or ongoing changes may incur additional charges, which we’ll always agree with you in advance.

  5. Final Payment & Delivery: The remaining 50% of the fee, plus any additional charges for size upgrades or extras, is payable upon approval of the final artwork. Your print will then be produced and shipped via Royal Mail (tracked service). We can deliver directly to you or your gift recipient.

5. Revisions and changes to brief 

  1. Each Memorarto commission includes one round of refinements following the initial artwork preview. These refinements are intended for small adjustments—such as layout, balance, or minor detail changes.

  2. Requests for revisions must be made within 3 standard business days of receiving your preview image. Delays beyond this may impact your expected production and delivery timeline.

  3. Substantial changes—such as altering the central theme or replacing key photos—may require a redesign. In these cases, an additional fee will apply, or in extreme cases the project may need to be reconfirmed as a new commission.

  4. To ensure a smooth process, we ask that your intended focus (e.g. recipient, event, or memory) is clearly communicated before work begins.

  5. Changes to the core brief after the design process has started may delay delivery and are not always possible within the original timeline or price.

6. Pricing and Payment

  • All prices are in GBP (£), unless otherwise specified. Your payment provider may apply currency conversion fees depending on your location. 

  • A 50% deposit is required upfront to secure your place in our commission schedule. This deposit reserves your place in our creative calendar and secures dedicated time for your bespoke artwork. As such, it is non-refundable, except in specific circumstances at our discretion. See the Returns and Refunds section below for more details.

  • Final balance must be paid before artwork is printed or released.

  • Payments are accepted via secure online methods.

7. Delivery

  • Commissioned Artworks are printed by our UK-based fine art printer and shipped using tracked delivery, courtesy of Royal Mail domestic and international services. 

  • Delivery times will vary depending on your location, but we will provide an estimated timeline during the commission process.

  • We are not liable for delivery delays once the item has been dispatched via Royal Mail.

  • You are responsible for any customs or import duties incurred

8. Returns and Refunds

  • Due to the personalised nature of our products, standard right-to-cancel provisions under the Consumer Contracts Regulations (2013) do not apply once work has commenced. Therefore Bespoke Commissions are non-refundable once work has commenced.

  • If we fail to deliver the agreed work within the outlined timeframe or do not meet key milestones, you may be eligible for a partial or full refund at our discretion

  • If your print arrives damaged, please contact us within 7 days with photos so we can arrange a replacement

9. Cancellations

  • Due to the bespoke nature of our service, deposits are non-refundable once paid and your booking is confirmed in writing, as they reserve dedicated time in our limited creative schedule. 

  • If we are unable to proceed with your commission after reviewing your full materials, we will issue a full refund.

  • If you have concerns or wish to discuss your order after booking, please get in touch — we’re always happy to help.

10. Intellectual Property

  • Craig Baxter retains full copyright of all artworks

  • Clients receive a personal-use license only (e.g. display in home, gifts)

  • Artworks may not be reproduced, resold, or used for commercial purposes without written permission

  • You're very welcome to share your finished artwork with friends and family or on social media — and if you do, we’d love it if you'd tag us! @memorarto

11. Client Responsibilities​

  • You must have the right to use any images or materials you provide

  • You agree not to submit any material that is unlawful, offensive, defamatory, obscene, or infringes on the rights of others

  • You agree not to submit images that infringe on copyright or intellectual property rights. Where you include recognisable third-party content (e.g. professional photography, brand logos), you confirm you have permission to use it for personal artistic purposes

  • We reserve the right to decline or delete any materials we believe may be inappropriate or incompatible with our values or legal obligations.

  • We reserve the right to suspend or cancel a commission if supplied content is unlawful or cannot be safely used.

  • Please ensure submitted image scans are high quality, minimum 300dpi, ideally 600dpi

  • Timely communication and feedback help us stay on schedule

12. Liability

  • We are not responsible for delays caused by third parties (printers, couriers, customs)

  • We are not liable for misuse, reproduction, or modification of the final artwork by the client or third parties

  • Our total liability to you in connection with any commission shall not exceed the amount paid for that commission.

13. Privacy and Data Use

  • We use your personal data (including photos and story content) only to complete your artwork and communicate with you about your order

14. Use of Artwork and Materials for Marketing

With your permission, we may use your finished Commissioned Artwork and, if applicable, a before-and-after view (including photos you’ve submitted) in our portfolio, social media, or marketing materials.

  • This permission will be requested in our follow-up form, after your order is confirmed.

  • We will never share personal images, identifiable story details, or raw content without your explicit consent.

  • You may withdraw your permission at any time by contacting us.

15. Changes to These Terms

We may occasionally update these Terms. Updates take effect once published. Continued use of our services constitutes acceptance of the latest version.

16. Governing Law and Jurisdiction

These Terms and any disputes arising under them shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
